Terms of Service

These terms are the agreement between you and BNS Data, Sydney, Australia (“we”, “us”), the operator of Svayam Yoga (“Svayam”). They cover your use of svayam.yoga and the Svayam application. By creating an account you accept them.

1. Your account

You must be at least 16 years old to create an account, and you agree to give accurate information and keep it current. You are responsible for what happens under your account and for keeping your password to yourself. Tell us promptly if you think someone else has access to it.

One person, one account. Do not share your login or resell access to the platform.

2. Health and safety - please read this one

Svayam is not a medical service and does not provide medical advice. Posture assessment is an aid to your own judgement, not a diagnosis. It can be wrong, and it cannot see everything a person in the room with you would see.

Yoga involves physical exertion and carries a risk of injury. You take part at your own risk. Before you start, consult a doctor if you are pregnant, recovering from injury or surgery, managing a chronic condition, or have any reason to think physical activity may not be safe for you.

Stop immediately if you feel pain, dizziness or shortness of breath. Do not push into a pose because the platform or a teacher suggested it. You know your body; the software does not.

What you are responsible for

We are not in the room with you. Nobody at Svayam can see your floor, your furniture or how your device is propped up, and the posture engine only sees what fits in the camera frame. Setting your practice up safely is your responsibility, and it is a condition of using the platform:

  • Clothing. Wear comfortable, close-fitting clothing you can move freely in and that stays in place when you fold, twist or invert. Posture analysis works from the outline of your body, so loose or draped clothing makes the feedback less accurate. Be properly and modestly dressed whenever your camera is on — a live class or a posture session may be seen by a teacher, and a live class by other students.
  • Your space. Practise on a level, non-slip surface with room to fully extend your arms and legs in every direction. Clear furniture, cords, glass and sharp corners out of the way before you begin, and make sure the light is good enough for the camera to see you.
  • Your equipment. Your mat and any props — blocks, straps, bolsters, blankets, chairs — are yours to provide and yours to check. Do not practise on a mat that slides, a worn strap, or a chair that is not stable.
  • Your device. Place your phone, tablet or laptop where it stands securely and cannot fall on you or be knocked into your practice space.
  • Your condition. Do not practise under the influence of alcohol or anything that affects your balance, judgement or ability to feel pain. Practise on a light stomach and keep water within reach.
  • Your level. Warm up, choose classes and courses that match your experience, and work at your own pace. Tell your teacher before a live session about any injury, pregnancy or condition that affects what you can safely do.
  • Other people and animals. You are responsible for anyone else in your practice space, including children and pets.

If you cannot meet these conditions for a given session, do not start it.

3. The free trial

New accounts get a free allowance without entering card details: three posture assessments, one live class, one course and one guided drill. The allowances are counted separately, so using one does not consume another. Once an allowance is used it does not reset. Choosing a plan is what restores access.

4. Subscriptions and payment

  • Plans are billed in advance, monthly or quarterly, in the currency you choose at checkout. The price shown at checkout is the price charged.
  • Subscriptions renew automatically at the end of each period until you cancel. We will email you a receipt for each renewal.
  • Payment is handled by Stripe, and Stripe's terms apply to the payment itself. We do not see or store your card number.
  • You can change plan at any time from Manage billing. Stripe prorates the change, so you pay only the difference for the remainder of the current period.
  • You may hold one active subscription at a time. If a payment fails we will email you and allow a short grace period before access is suspended.
  • We may change prices, but not for a period you have already paid for. We will give you at least 30 days' notice by email before a change affects your renewal, and you can cancel before it takes effect.

5. Cancelling

Cancel any time from Manage billing on your subscription page. Cancellation takes effect at the end of the period you have already paid for - you keep full access until then and are not charged again. Refunds are covered in our refund policy.

6. Teachers

Teachers on Svayam are independent practitioners, not our employees. They apply to join and every application is reviewed and approved by us before that teacher can publish anything. Teachers schedule and run their own classes and set their own availability.

We review applications in good faith, but we do not warrant any teacher's qualifications, methods or results, and the teaching relationship is between you and that teacher. Tell us if a teacher behaves inappropriately and we will act on it.

Teachers are paid out for completed sessions on our regular payout cycle, less the platform fee disclosed to them when they join.

7. Recordings

Posture recording is opt-in. If you consent, the recording is encrypted on your device before upload and may be reviewed by an approved teacher so they can give you feedback. You can withdraw consent at any time, which deletes it. See the privacy policy for how this works in detail.

Recordings are deleted within 72 hours. That is a privacy commitment, and it applies to us as much as to you - we cannot recover a recording after the window closes. If a teacher does not get to your review in time, we will ask you to record the assessment again. The skeleton data we derive from a recording is not deleted, because it is what your progress history is made of.

Do not record, screenshot or redistribute a teacher's class or another student's session. Other people in a live class have the same expectation of privacy that you do.

8. Acceptable use

You agree not to:

  • harass, abuse or discriminate against teachers or other students;
  • share, resell or republish course material, classes or recordings;
  • scrape the platform, or try to break, overload or gain unauthorised access to it;
  • use the platform for anything unlawful.

We may suspend or close an account that breaches these terms. Where the breach is not serious we will normally warn you first.

9. Our content and intellectual property

Courses, drills, guidance content, software and branding on Svayam belong to us or to the teachers who created them. Your subscription is a personal, non-transferable licence to use them while it is active. It does not transfer ownership of anything.

What you upload stays yours. You grant us the licence we need to store it, show it back to you, and - where you have consented - show it to a teacher reviewing your practice.

Patents. Certain technologies used or proposed for use by Svayam Yoga are the subject of pending patent applications, including the Svayam Yoga Posture Assessment and Teacher Escalation System, and the Svayam Dedicated Pranayama Assessment and Posture Monitoring System. Our Patent Notice carries the full statement.

10. Availability

We aim to keep Svayam available but do not guarantee uninterrupted service. We may need to take it down for maintenance, and features may change over time. If we discontinue a paid feature materially, you may cancel and we will refund the unused portion of your period.

11. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded. Where our liability can be limited, it is limited to re-supplying the service or refunding what you paid us in the twelve months before the claim.

We are not liable for the acts or omissions of individual teachers, or for injury arising from physical practice you chose to undertake.

12. Changes to these terms

We may update these terms. If a change is material we will email account holders before it takes effect. Continuing to use Svayam after that means you accept the updated terms.

13. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.
